Coca-Cola applied for a three-dimensional trademark refuted and sued the National Trademark Evaluation Committee

The Coca-Cola Company wanted to register its Fantaic Soda Bottle as a trademark and was rejected by the Trademark Review and Adjudication Board of China. The Coca-Cola Company filed a lawsuit against the National Trademark Review Board. Yesterday, the reporter learned from Beijing No. 1 Intermediate People's Court that the court dismissed the Coca-Cola company’s demands.

It is understood that the Trademark Office of China believes that the application for the trademark is a common container for beverages. It is used as a trademark lacking distinctive features and it has decided to reject the registration application for the trademark. The Coca-Cola Company disagreed and applied for review by the National Trademark Review and Adjudication Board. The National Trademark Review and Adjudication Board made a decision and rejected it.

Since then, Coca-Cola has lodged a complaint with the National Trademark Review and Adjudication Board to the Municipal Intermediate Court. The City First Intermediate People's Court believes that the relevant public can easily identify the application trademark as a beverage packaging container, and it is not easy to identify it as a three-dimensional logo that distinguishes the source of the goods. Therefore, the lack of trademark application for a trademark should be significant and should not be registered.
